Are remote workers for CA employers entitled to workers’ comp?

On Behalf of | Jan 2, 2025 | Workers' Compensation

The rise of remote work has reshaped the American workplace in recent years. As a result, it isn’t surprising that many people still have questions about the lesser-known aspects of remote work. For example, are you entitled to workers’ compensation in California if you’re injured while working from home?

The answer to this question (most of the time) is yes, as remote workers for California employers are generally covered by workers’ compensation insurance. However, specific criteria must be met to qualify for benefits.

Key considerations

California law requires employers to invest in workers’ compensation insurance coverage for their employees, whether they work on-site or remotely. This coverage applies to injuries or illnesses that develop or are exacerbated during the course and scope of employment. For remote workers, this means that injuries suffered while performing job-related tasks at home may qualify for workers’ comp benefits.

For example, if you trip over a computer cable while working at your desk in your home office or develop repetitive strain injuries from typing, these incidents may qualify as work-related. However, injuries suffered while doing personal tasks, such as walking your dog or cooking lunch, would likely not be covered.

With that said, remote work can complicate workers’ compensation claims because employers and insurers may question whether an injury is truly work-related. Additionally, the burden of proof that an injury was suffered while working often falls more heavily on remote employees. As a result, it is generally a good idea to seek personalized legal guidance as soon as possible after harm occurs. Doing so can help to facilitate a successful claim.
